Could New Jersey be the Next State to Join the Noncompete Ban Wagon?
A bill has been introduced in every New Jersey legislative session since 2022 proposing to render employment noncompete agreements (NCA) unenforceable. And each time the proposed bill has died on the vine at the end of each term. So, when New Jersey Assembly Bill A5708 cleared the Assembly Labor Committee on December 4, 2025, in a bipartisan 8-2 vote, all eyes turned to New Jersey as the next state to possibly join the NCA ban wagon. We’ve heard this before. Why the sudden optimism? The bill has rare bipartisan support, and was quickly referred the same day to the Assembly Regulated Professions Committee. All signs suggest that the Bill may be headed to the Assembly floor before the Legislature adjourns on January 12, 2026. Governor Murphy may seek to end his term in January with legacy legislation like A5708 that would make New Jersey just the 5th state to join the ban wagon.
