Generative AI in Sports: Using AI Tools Without Jeopardizing Confidentiality or Privilege
Generative artificial intelligence tools offer compelling efficiencies across the sports industry, from player evaluation and recruiting insights to sponsorship analytics, ticketing optimization, and game-day operations. However, their use raises legal risks related to confidentiality, attorney–client privilege and work product, preservation and discovery, and contractual rights. Professional sports organizations, leagues, teams, venues, event operators, sports marketing and sponsorship groups, and college athletics departments and NIL collectives should adopt thoughtful guardrails before deploying these tools in workflows that touch sensitive data or legal strategy.

Unchartered Waters: The AI Phishing Wave Is Here
Attorneys, Kate A. Sherlock and Nicholas T. Franchetti, authored the article, "Unchartered Waters: The AI Phishing Wave Is Here," for the New Jersey Law Journal writing, "AI is poised to make both traditional and spear phishing cheaper and more effective." For traditional phishing, AI can generate and send thousands of emails in virtually no time, whereas an individual threat actor would have needed minutes or hours to write each underlying email. Moreover, as AI has become more sophisticated, studies have shown that AI-generated emails are now indistinguishable from those written by humans. AI’s effect on spear phishing has been even more pronounced.

Using AI Tools Without Jeopardizing Confidentiality or Privilege
Generative artificial intelligence tools have moved from novelty to ubiquity over the last year. Employees across all industries and departments are routinely feeding company and customer information into AI chatbots, AI “assistants,” and other AI tools to increase productivity. Much of this adoption is happening informally, without legal or IT sign-off, and often without anyone considering what happens to the data once it is typed into a prompt window.

U.S. companies that collect and store sensitive personal data have until July 8, 2025 to comply with a new Department of Justice rule, known as the Data Security Program (“DSP”). What is the Data Security Program? The DSP prohibits U.S. companies from sharing bulk sensitive personal data with individuals or entities from countries identified as foreign adversaries, including but not limited to China, Russia, Cuba, Venezuela, and Iran (“Covered Person(s)”). Under the program, sensitive personal data is defined broadly and is not limited to traditional "PII", such as social security numbers and bank account information. Instead, the DSP aims to protect a much broader scope of information, including but not limited to human genomic information, geolocation information, biometric and health information, and financial information. Additionally, the DSP applies to government-related data, including any precise geolocation data and sensitive personal data that a transacting party markets as linked or linkable to certain current or recent former U.S. government employees.

New Jersey’s Comprehensive Data Privacy Law Now in Effect
New Jersey’s comprehensive data privacy law goes into effect today, January 15, 2025. The law gives New Jersey consumers greater control over their data and imposes significant obligations on businesses that collect and process such data. Some of the obligations include publishing a privacy policy detailing the business’s data collection, processing, and disclosure practices, providing consumers with the option to opt-out of the collection and disclosure of their information, and entering into written data processing agreements with third-party vendors that will be accessing or processing personal information.
