A key but relatively unknown provision of the health care reform law enacted in March 2010 authorized the extension of the Medicare RAC program to state Medicaid programs (P.L. 111-148, the Patient Protection and Affordable Care Act or "PPACA").

Over the course of 2022, the New Jersey Department of Health (the “Department”) implemented, in stages, sweeping changes to the state regulatory process related to transfers of ownership of nursing homes. The changes stem from legislation that took effect on November 8, 2021, amending the Health Care Facility Planning Act (found at N.J.S.A. 26:2H-7.25-27) to increase oversight of nursing home ownership and management arrangements following the negative publicity affecting the industry during the COVID-19 pandemic between 2020-21. The law now includes more rigorous requirements for filing regulatory applications for transfers of ownership, including disclosure of property ownership and management agreements, as well as a new public comment process and a public hearing for certain categories of applications.

On December 14, 2020, Governor Phil Murphy signed new legislation (S-848/A-2140) into law revising requirements for New Jersey health care service firms to report financial information to the Division of Consumer Affairs (“Division”). Health care service firms are agencies, registered with the Division that place or arrange for the placement of personnel to provide health care or personal care services in the residence of an individual. P.L. 2020 c.132 took effect immediately and, among other things, replaces the prior triennial audit requirement for some health care service firms and extends to December 31, 2022, the earliest deadline for those firms that will still be required to file them.
