Deference Isn't Dead: NJ's Environmental Justice Rules

In its 2024 decision in Loper Bright Enterprises v. Raimondo, 603 U.S. 369 (2024), the United States Supreme Court overruled the principle of "Chevron deference" that had been established four decades prior. Many observers predicted this ruling signaled the beginning of the end of deference to agency rulemaking, including environmental agencies. However, the Appellate Division of New Jersey recently signaled that the reports of the demise of agency deference may have been greatly exaggerated. On January 5, 2026, New Jersey's Appellate Division, in its decision in IN THE MATTER OF THE ADOPTION OF N.J.A.C. 7:1C., A-2936-22, A-2959-22, upheld the New Jersey Department of Environmental Protection's adoption of its Environmental Justice rules and regulations at N.J.A.C. 7:1C, which implement New Jersey's Environmental Justice Law, N.J.S.A. 13:1D-157 to -161. In so upholding, New Jersey's Appellate Division appears to have conducted its administrative law analysis unconstrained by the Loper decision. This decision is considered a win for New Jersey's low-income communities and communities of color, as a stated purpose of the EJ Rules is to "correct [the] historical injustice" of "New Jersey's low-income communities and communities of color hav[ing] been subject to a disproportionately high number of environmental and public health stressors..." This panel will explore the bases for EJ Rules, how those Rules are expected to impact life in overburdened communities, how and when they are applied, and how the foundations for rulemaking affected the Appellate Decision's analysis of agency deference.
