Jeffrey Scott Interviewed for NJ Law Journal Article, "NJAG’s Guidance on Student Discipline May Open ‘Floodgate of Litigation’"

The New Jersey Law Journal article, “NJAG’s Guidance on Student Discipline May Open ‘Floodgate of Litigation’,” is centered around New Jersey's latest guidance on preventing discrimination in school discipline. Jeffrey Scott, Archer Civil Rights Group Partner, was interviewed by author Colleen Murphy about his view on how school districts should handle the guidance and whether the guidance will have an impact on civil litigation.

Jeff stated, “I think it is too early to come to a conclusions, but the new guidelines themselves could act as a sort of new industry standard and that it might increase new claims of disparate treatment or discrimination under New Jersey LAD or under existing federal law…time will tell whether or not civil right lawsuits will be filed based on these new guidelines. I do think these guidelines could act as both a road map for an attorney who represents the student and the parent, and for the attorney who represents the school district.” He goes on caution schools to take the guidelines seriously and implement additional training for staff.
